欢迎使用 WakePaw。

WakePaw(以下简称「本应用」)由我们开发与运营。

本协议是你与我们之间关于使用本应用的法律协议,涵盖本应用的客户端、后续更新版本及相关服务。

请你在使用 WakePaw 前仔细阅读并充分理解本协议,特别是与服务限制、安全使用、自动续费、责任限制、虚拟物品及未成年人使用有关的条款。

当你首次使用 WakePaw,并主动勾选、点击「同意」「同意并继续」或其他具有相同含义的按钮时,即表示你已阅读、理解并同意接受本协议。

如果你所使用的版本尚未展示前述勾选步骤,你下载、安装或继续使用 WakePaw,亦视为已阅读并同意本协议。

如果你不同意本协议,请停止使用 WakePaw。


1. 服务说明

1.1 协议主体

本协议是你与个人开发者吴丽娟(以下简称「我们」)之间关于使用 WakePaw 的法律协议。

1.2 产品功能

WakePaw 是一款面向个人用户的闹钟与清醒任务(Mission)应用,主要可能提供以下功能:

  • 基于 iOS 系统闹钟能力的叫醒服务;
  • 闹钟触发后的清醒任务(Mission);
  • 数学题、快速点击、记忆、运动等任务;
  • 重复提醒、跟催及起床流程;
  • 宠物陪伴、成长记录及应用内成就;
  • 晨光、缓醒卡、食物、勋章等应用内虚拟资产;
  • 自定义铃声、叫醒语音等个性化能力;
  • Pro 会员、去广告以及其他增值服务;
  • WakePaw 后续上线的其他功能。

具体功能以你所使用版本及应用内实际展示为准。

1.3 系统依赖

WakePaw 当前主要面向 iOS 平台。

部分功能依赖 Apple 提供的系统能力,包括但不限于:

  • AlarmKit;
  • 通知;
  • 实时活动;
  • 相机;
  • 麦克风;
  • 动作或姿态识别;
  • 网络及系统 iCloud 备份(若你已在系统中开启);

相关功能是否可用,会受到设备型号、iOS 系统版本、系统权限、Apple 系统能力以及 WakePaw 当前版本的影响。

WakePaw 对系统版本的具体要求,以 App Store 页面展示的信息为准。

1.4 非医疗用途

WakePaw 是一款效率、习惯与闹钟辅助工具,并非医疗器械,也不提供:

  • 医疗诊断;
  • 睡眠障碍诊断;
  • 心理诊断;
  • 康复治疗;
  • 健身或医疗处方;
  • 其他专业医疗建议。

WakePaw 所提供的闹钟、任务、记录和提醒,仅用于帮助用户建立起床及生活习惯,不应被视为专业医疗意见的替代品。


2. 本机身份与数据

2.1 当前版本不提供登录

当前版本 WakePaw 不提供应用内账号登录(包括 Sign in with Apple)。你完成引导后即可在本机使用主要功能(含闹钟、宠物、晨光兑换、叫醒语音等)。

我们可能在本机为你生成或保存:

  • 昵称;
  • Wake ID(本机标识);
  • 头像与偏好设置。

上述信息用于本机展示与功能运行,不构成向我们服务器注册的云端账号。当前版本不自建账号服务器,也不会因「登录」向我们上传身份凭证。

如未来引入账号登录,我们将更新本协议,并另行说明登录方式、账号规则及注销方式。

2.2 本机数据

当前版本产生的闹钟、任务、宠物、晨光、叫醒语音等数据,原则上仅保存在设备本地。

如果发生以下情况:

  • 卸载 WakePaw;
  • 清除应用数据;
  • 更换设备;
  • 系统重置;
  • 设备损坏或遗失;

尚未随系统 iCloud 备份保存的数据可能无法恢复。

2.3 本机数据与 iCloud 备份

WakePaw 当前阶段不自建服务器保存你的宠物、晨光或叫醒语音。

上述数据保存在你的设备本地。若你在 iOS 系统设置中开启了 iCloud 备份,系统可能按 Apple 的规则,将本应用沙盒中的部分数据随整机自动备份到你自己的 iCloud。该备份由 Apple 提供,我们无法读取其内容。

开启或管理 iCloud 备份,请到系统「设置」中操作;WakePaw 不会在应用内单独弹出 iCloud 授权框,本机身份也不等于 iCloud 授权。

换机时,通常需要在新设备上选择从 iCloud 备份还原。仅重新安装应用,并不当然恢复此前本机数据。

2.4 Apple 购买记录

购买、恢复 Pro 会员、永久去广告或其他通过 App Store 完成的购买,一般以你的 Apple ID 购买记录为准,不要求 WakePaw 应用内登录。

WakePaw 本机身份与 Apple App Store 购买账号并不当然等同。

2.5 使用限制

你不得:

  • 利用本应用从事违法活动;
  • 利用程序漏洞异常获取虚拟资产;
  • 通过自动化程序、脚本等破坏正常服务;
  • 以其他方式恶意干扰服务正常运行。

2.6 注销账户与本机数据清除

当前版本不提供云端账号登录。本机可能生成昵称与 Wake ID 等身份信息。

你可以通过应用内入口完成注销:

我的 → 设置 → 账号管理 → 注销账户

注销须经应用内确认弹窗明确告知后果后,方可继续。确认后,我们将清除本机沙盒内与该身份相关的全部应用数据(含昵称、Wake ID、头像、闹钟、坚持项、宠物、晨光、勋章、叫醒语音与记录等),不可撤销。

你也可以通过卸载 WakePaw 或在系统设置中删除本应用,清除本机沙盒内的应用数据。

请注意:

注销账户或卸载 WakePaw 并不等同于取消 Apple App Store 自动续费订阅。

如果你存在尚未到期的自动续费服务,应同时通过 Apple 提供的订阅管理功能取消相应订阅。

系统 iCloud 中若仍保留注销或卸载前的整机备份,日后还原该备份可能恢复此前的本机状态,这由 Apple 的备份机制决定。


3. 闹钟、任务与系统权限

3.1 闹钟权限

WakePaw 的系统级闹钟功能依赖 Apple 提供的 AlarmKit 等系统能力及相应授权。

你需要按照应用提示授予所需权限。

任务页面、后续提醒、云同步及其他增强功能,还可能依赖:

  • 通知权限;
  • 网络;
  • 相机权限;
  • 麦克风权限;
  • 动作识别权限;
  • 其他系统权限。

3.2 无法正常提醒的情况

我们会合理努力提高 WakePaw 的稳定性,但任何软件均无法保证在所有设备及所有情况下百分之百正常运行。

以下情况可能导致闹钟、任务、提醒或同步异常:

  • 设备关机或电量耗尽;
  • iOS 系统异常或崩溃;
  • Apple 系统框架发生故障;
  • 必要权限被关闭或撤销;
  • 用户删除应用;
  • 用户主动关闭、删除或修改闹钟;
  • 用户修改设备日期、时间或时区;
  • 设备存储空间不足;
  • 系统版本或设备环境异常;
  • 网络连接异常导致需要联网的功能不可用;
  • Apple 或其他第三方服务发生异常;
  • 其他超出 WakePaw 合理控制范围的情况。

3.3 闹钟用途限制

WakePaw 不应被作为唯一的:

  • 医疗提醒工具;
  • 药物服用提醒;
  • 紧急求救工具;
  • 航班、考试或重大会议唯一提醒方式;
  • 婴幼儿或病患监护工具;
  • 消防、安防等安全系统;
  • 其他一旦提醒失败可能导致重大人身或财产损害的系统。

如提醒事项具有重大后果,建议同时设置其他独立提醒方式。


4. Mission 与运动任务安全

4.1 Mission 说明

WakePaw 可能要求用户在闹钟响起后完成一定任务,以帮助用户恢复清醒状态。

任务类型可能包括:

  • 数学题;
  • 记忆;
  • 快速点击;
  • 找不同;
  • 单词;
  • 摇晃设备;
  • 睁眼检测;
  • 深蹲;
  • 开合跳;
  • 其他动作任务。

任务类型及具体规则以应用内实际展示为准。

4.2 运动任务风险

部分 Mission 涉及身体活动。

在进行任何身体动作任务前,你应首先确认:

  • 自己已经处于能够安全活动的状态;
  • 周围不存在障碍物;
  • 地面稳定且不湿滑;
  • 当前不存在可能因身体移动造成危险的环境。

4.3 禁止危险场景使用

请勿在以下情况下完成需要操作手机或身体活动的 Mission:

  • 驾驶机动车时;
  • 骑自行车、电动车或其他交通工具时;
  • 正在道路上行走时;
  • 上下楼梯时;
  • 洗澡或位于湿滑环境时;
  • 位于高处时;
  • 操作机械、设备或工具时;
  • 抱持婴幼儿时;
  • 其他需要持续集中注意力或可能存在安全风险的场景。

在上述情况下,应优先保证自身及他人安全。

4.4 身体不适

如果在进行 Mission 时出现:

  • 头晕;
  • 疼痛;
  • 呼吸困难;
  • 胸闷;
  • 失去平衡;
  • 明显身体不适;

应立即停止任务。

用户应根据自己的年龄、身体状况、运动能力及实际环境选择合适的任务及难度。


5. 应用内资产与虚拟物品

5.1 虚拟资产性质

WakePaw 中可能存在:

  • 晨光;
  • 缓醒卡;
  • 食物;
  • 勋章;
  • 宠物成长值;
  • 连续完成记录;
  • 应用内积分;
  • 其他数字化权益。

除法律另有规定外,这些内容属于 WakePaw 服务中的虚拟物品或数字权益:

  • 不属于法定货币;
  • 不具有现金价值;
  • 不得兑换现金;
  • 不得要求 WakePaw 按现实货币回购。

5.2 获取与消耗

虚拟资产的:

  • 获取方式;
  • 消耗方式;
  • 数量;
  • 使用范围;
  • 有效期;
  • 任务失败结算;
  • 奖励规则;

以应用内实际公布的规则为准。

5.3 规则调整

我们可能根据:

  • 产品平衡;
  • 功能调整;
  • 技术原因;
  • 运营需求;
  • 防作弊需要;

合理调整虚拟资产规则。

对于已经实际购买的数字商品、已经生效的付费权益及用户已经依法取得的核心权益,我们不会仅因普通运营规则调整而无合理依据地追溯剥夺。

5.4 异常资产

如果存在:

  • 利用漏洞;
  • 修改客户端;
  • 自动化脚本;
  • 非正常方式刷取奖励;
  • 数据篡改;
  • 其他作弊行为;

我们有权根据情况采取:

  • 修正异常数据;
  • 收回异常资产;
  • 重置异常记录;
  • 暂停相关功能;
  • 限制部分功能;
  • 终止服务;

等合理措施。

5.5 坚持类结果

WakePaw 的部分设计可能将“坚持完成”本身作为产品体验的重要组成部分。

因此部分结果原则上不能通过付费直接购买,包括但不限于:

  • 直接购买起床成功结果;
  • 直接购买 Mission 完成状态;
  • 直接修改真实任务完成记录;
  • 直接恢复部分代表实际坚持结果的记录。

具体以应用内规则为准。


6. Pro 会员、付费与自动续费

6.1 购买渠道

WakePaw 的 Pro 会员、去广告、永久解锁或其他数字商品,通过 Apple App Store 提供的应用内购买系统完成。

实际:

  • 价格;
  • 币种;
  • 税费;
  • 套餐;
  • 优惠;
  • 订阅周期;

以购买页面及 Apple 显示的信息为准。

6.2 自动续费

如果你购买自动续费会员,相关订阅将在当前订阅周期结束时按照 Apple 的规则进行续订,除非你提前取消。

在购买前,WakePaw 会在购买页面展示重要订阅信息。

自动续费的具体规则另见:

《WakePaw 自动续费会员服务协议》

6.3 管理订阅

自动续费服务由 Apple 管理。

你可以通过 iOS 系统中的 Apple 账号订阅管理页面:

  • 查看订阅;
  • 更改订阅;
  • 取消订阅。

删除或卸载 WakePaw App 不会自动取消你的 App Store 自动续费订阅。

6.4 恢复购买

在 Apple 规则允许的范围内,你可以通过 WakePaw 的“恢复购买”等功能恢复与当前 Apple ID 关联的:

  • 有效订阅;
  • 永久买断项目;
  • 其他支持恢复的购买。

6.5 退款

WakePaw 的应用内购买通过 Apple App Store 完成。

退款资格、退款流程及退款结果主要根据:

  • Apple 的退款规则;
  • 用户所在国家或地区的法律;
  • 具体购买情况;

确定。

除适用法律另有强制规定外,我们无法保证所有已经购买或消费的数字商品均能够退款。

6.6 服务调整

如果因产品升级、技术调整或服务变化导致部分 Pro 功能发生调整,我们会尽合理努力确保用户已经支付的核心会员权益不会被无合理依据地实质性减少。


7. 用户内容

7.1 用户生成内容

你可能可以在 WakePaw 中创建或上传:

  • 叫醒语音;
  • 昵称;
  • 头像;
  • 自定义文本;
  • 其他用户内容。

相关内容的合法权利原则上仍归你或原权利人所有。

7.2 必要使用许可

为向你提供 WakePaw 服务,你同意授予我们仅在提供相关功能所必需范围内使用这些内容的许可,例如:

  • 本地存储;
  • 本地播放;
  • 随系统 iCloud 备份(若你已在系统中开启);
  • 内容展示。

除非取得你的另行授权或法律另有规定,我们不会因为本协议而取得与你提供服务无关的内容使用权。

7.3 用户义务

你不得通过 WakePaw 上传、录制或传播:

  • 违法内容;
  • 侵犯他人著作权的内容;
  • 侵犯隐私或肖像权的内容;
  • 恶意骚扰内容;
  • 仇恨、威胁或其他违法违规内容。

7.4 本地识别

如 WakePaw 使用动作、姿态、面容特征或类似识别能力,其数据处理方式、是否上传服务器等情况,以《WakePaw 隐私政策》中的说明为准。


8. 未成年人使用

8.1 监护人指导

如果你是未满十八周岁的未成年人,请在父母或其他监护人的指导下使用 WakePaw。

涉及付费购买时,应取得监护人的同意,并按照法律法规及 Apple 的相关规则进行。

8.2 运动任务

未成年人使用深蹲、动作识别等运动类任务时,应特别注意任务难度和使用环境。

我们建议监护人帮助未成年人:

  • 选择合适的任务;
  • 设置合理任务强度;
  • 避免在危险场景下使用。

8.3 儿童个人信息

如果 WakePaw 涉及处理法律所规定的儿童个人信息,我们将依照适用法律及《WakePaw 隐私政策》采取相应保护措施。


9. 知识产权

9.1 WakePaw 内容

除用户内容或另有明确说明的第三方内容外,WakePaw 中的:

  • 软件代码;
  • 产品名称;
  • Logo;
  • UI 设计;
  • 页面布局;
  • 图形;
  • 插画;
  • 宠物形象;
  • 动画;
  • 文案;
  • 铃声;
  • 音效;
  • 数据结构;
  • 其他原创内容;

相关知识产权归个人开发者吴丽娟或合法权利人所有。

9.2 使用限制

未经相应权利人许可,你不得:

  • 非法复制;
  • 批量抓取;
  • 修改;
  • 出售;
  • 出租;
  • 转授权;
  • 传播;
  • 反向工程;
  • 破解;
  • 绕过付费机制;
  • 以其他侵犯知识产权的方式使用 WakePaw。

法律明确允许的行为除外。

9.3 第三方内容

WakePaw 中部分:

  • 字体;
  • 音效;
  • 开源组件;
  • 软件框架;
  • 其他资源;

可能来自第三方,并按照相应授权协议或许可规则使用。

其知识产权仍归相应权利人所有。


10. 禁止行为

在使用 WakePaw 时,不得实施以下行为:

  • 违反法律法规;
  • 入侵服务器或客户端;
  • 破解 WakePaw;
  • 修改应用数据;
  • 绕过订阅或付费机制;
  • 利用漏洞获取不当利益;
  • 使用自动化脚本恶意刷取奖励;
  • 对服务器进行攻击;
  • 影响其他用户正常使用;
  • 冒充他人;
  • 利用 WakePaw 从事欺诈;
  • 侵犯第三方合法权益;
  • 其他明显违背正常产品使用目的的行为。

如发生上述行为,我们可以根据行为严重程度采取合理措施。


11. 第三方服务

WakePaw 可能依赖第三方提供的服务,包括但不限于:

  • Apple;
  • App Store;
  • iCloud 备份(由系统提供);
  • Apple 系统框架;
  • 云服务提供商;
  • 崩溃分析或性能服务;
  • 其他技术服务商。

第三方服务可能受其自身:

  • 服务条款;
  • 隐私规则;
  • 技术状况;
  • 系统维护;

影响。

因第三方发生故障导致部分功能短暂不可用时,我们会尽合理努力协助处理,但无法控制第三方服务本身。


12. 服务调整、暂停与终止

12.1 产品调整

为了:

  • 提升用户体验;
  • 修复问题;
  • 保证系统安全;
  • 适应系统升级;
  • 遵守法律法规;
  • 调整商业模式;

我们可能对 WakePaw 的功能进行新增、修改或下线。

12.2 暂停服务

出现以下情况时,部分或全部服务可能暂时无法提供:

  • 系统维护;
  • Apple 服务异常;
  • 服务器维护;
  • 网络攻击;
  • 安全风险;
  • 不可抗力;
  • 法律法规要求;
  • 其他合理原因。

12.3 用户终止使用

你可以随时停止使用 WakePaw 并卸载应用,以清除本机应用数据。

12.4 违规终止

如果用户严重或持续违反本协议,我们可以根据实际情况:

  • 警告;
  • 限制部分功能;
  • 暂停服务;
  • 终止服务;
  • 删除违法违规内容;

法律另有规定的除外。


13. 免责声明与责任限制

13.1 服务现状

WakePaw 按照产品当前实际状态向用户提供服务。

我们会采取合理措施保障:

  • 产品安全;
  • 服务稳定;
  • 数据安全;
  • 功能正常运行。

但由于软件、设备和操作系统本身具有复杂性,我们无法承诺:

  • 服务永不发生中断;
  • 所有设备表现完全一致;
  • 所有功能始终不存在错误;
  • WakePaw 能满足所有用户的特殊需求。

13.2 用户自身原因

因用户自身行为导致的问题,例如:

  • 权限关闭;
  • 设备没电;
  • 删除应用;
  • 删除闹钟;
  • 错误设置时间;
  • 未按照提示操作;
  • 在危险环境中完成任务;

应结合实际情况确定责任。

13.3 第三方及不可控制因素

对于由于:

  • Apple 系统异常;
  • App Store 故障;
  • 第三方服务中断;
  • 网络故障;
  • 设备硬件问题;
  • 不可抗力;

等超出我们合理控制范围的因素造成的服务异常,我们将在适用法律允许的范围内承担相应责任。

13.4 责任范围

在适用法律允许的范围内,我们仅就依法应由我们承担的直接损失承担相应责任。

本协议中的任何责任限制均不适用于法律明确规定不得限制或排除的责任,包括但不限于:

  • 因我们的故意造成的损害;
  • 因我们的重大过失造成的依法不得免责的损害;
  • 法律规定不得排除的人身损害责任;
  • 其他依法不得通过格式条款限制的责任。

14. 隐私与个人信息保护

我们重视你的隐私及个人信息安全。

WakePaw 对个人信息的:

  • 收集;
  • 使用;
  • 存储;
  • 共享;
  • 删除;
  • 权限使用;
  • 安全保护;

将按照 《WakePaw 隐私政策》 进行。

使用 WakePaw 前,请同时阅读《WakePaw 隐私政策》。

如果某项功能需要访问:

  • 麦克风;
  • 相机;
  • 通知;
  • 动作数据;
  • 照片;
  • 其他系统权限;

我们会通过系统授权或应用内说明向你进行提示。


15. 协议变更

15.1 普通调整

随着 WakePaw 功能、业务或法律环境发生变化,我们可能对本协议进行修改。

更新后的协议会通过:

  • WakePaw 应用;
  • 协议页面;
  • 其他合理渠道;

进行公布,并更新生效日期。

15.2 重大调整

如果修改涉及:

  • 收费方式;
  • 用户重大权益;
  • 主要服务内容;
  • 责任承担;
  • 个人信息处理方式;
  • 其他对用户具有重大影响的事项;

我们将通过弹窗、显著页面提示或其他合理方式进行通知。

依法需要重新取得用户同意的,我们将重新征得你的同意。


16. 适用法律与争议解决

本协议的订立、效力、解释、履行及争议解决,原则上适用中华人民共和国法律,但不包括其冲突法规则。

如果你所在国家或地区的强制性法律规定赋予消费者不可排除的权利,该等强制性规定仍然适用。

因本协议或 WakePaw 服务产生争议时,双方应首先尽量通过友好协商解决。

协商无法解决的,可依法向具有管辖权的人民法院提起诉讼。


17. 其他条款

17.1 条款独立性

如果本协议中的部分条款被认定为无效或不可执行,不影响其他条款的有效性。

17.2 标题

本协议中的标题仅用于阅读和理解,不影响相关条款的实际含义。

17.3 未行使权利

我们未立即行使本协议中的某项权利,不代表我们永久放弃该项权利。

反馈技术问题时,如你愿意,可自行附上版本号、系统与问题描述;我们不会在后台自动附带这些信息。

我们会在合理范围内处理你的反馈。

Welcome to WakePaw.

WakePaw (hereinafter referred to as “the App”) is developed and operated by us.

This Agreement is a legal agreement between you and us concerning your use of the App, covering the App’s client, subsequent updated versions, and related services.

Please read this Agreement carefully and fully understand it before using WakePaw, especially the terms relating to service limitations, safe use, auto-renewal, limitation of liability, virtual items, and use by minors.

When you first use WakePaw and actively check, tap “Agree,” “Agree and Continue,” or another button with the same meaning, you represent that you have read, understood, and agreed to accept this Agreement.

If the version you are using does not yet display the foregoing check-box step, your downloading, installing, or continued use of WakePaw will also be deemed to constitute having read and agreed to this Agreement.

If you do not agree to this Agreement, please stop using WakePaw.


1. Description of Services

1.1 Parties to this Agreement

This Agreement is a legal agreement between you and individual developer Lijuan Wu (吴丽娟) (hereinafter referred to as “we,” “us,” or “our”) concerning your use of WakePaw.

1.2 Product Features

WakePaw is an alarm clock and wake-up Mission app for individual users, and may primarily provide the following features:

  • wake-up services based on iOS system alarm capabilities;
  • Missions after an alarm is triggered;
  • tasks such as math problems, rapid tapping, memory, and physical activity;
  • repeated reminders, follow-up prompts, and the wake-up flow;
  • pet companionship, growth records, and in-app achievements;
  • in-app virtual assets such as Morning Light (晨光), Snooze Cards, food, and badges;
  • personalized capabilities such as custom ringtones and wake-up voice;
  • Pro membership, ad removal, and other value-added services;
  • other features that WakePaw subsequently launches.

Specific features are as shown in the version you use and as actually displayed in the App.

1.3 System Dependencies

WakePaw currently primarily targets the iOS platform.

Some features depend on system capabilities provided by Apple, including without limitation:

  • AlarmKit;
  • notifications;
  • Live Activity;
  • camera;
  • microphone;
  • motion or pose recognition;
  • network and system iCloud Backup (if you have enabled it in system settings);

Whether related features are available will be affected by device model, iOS system version, system permissions, Apple system capabilities, and the current version of WakePaw.

WakePaw’s specific system version requirements are as shown on the App Store page.

1.4 Non-Medical Use

WakePaw is a productivity, habit, and alarm assistance tool. It is not a medical device and does not provide:

  • medical diagnosis;
  • diagnosis of sleep disorders;
  • psychological diagnosis;
  • rehabilitation treatment;
  • fitness or medical prescriptions;
  • other professional medical advice.

The alarms, tasks, records, and reminders provided by WakePaw are intended only to help users build wake-up and lifestyle habits, and should not be regarded as a substitute for professional medical advice.


2. On-Device Identity and Data

2.1 No In-App Sign-In in the Current Version

The current version of WakePaw does not provide in-app account sign-in (including Sign in with Apple). After completing onboarding, you may use the main features on this device (including alarms, pets, Morning Light redemption, and wake-up voice).

We may generate or store on this device:

  • a nickname;
  • a Wake ID (on-device identifier);
  • an avatar and preference settings.

This information is used for on-device display and feature operation and does not constitute registering a cloud account on our servers. The current version does not operate an account server and will not upload sign-in credentials to us because of “logging in.”

If account sign-in is introduced in the future, we will update this Agreement and separately describe sign-in methods, account rules, and deletion.

2.2 On-Device Data

Alarm, task, pet, Morning Light, wake-up voice, and similar data generated in the current version is, in principle, stored only locally on the device.

If any of the following occurs:

  • uninstalling WakePaw;
  • clearing app data;
  • changing devices;
  • a system reset;
  • device damage or loss;

data that has not been saved with system iCloud Backup may be unrecoverable.

2.3 On-Device Data and iCloud Backup

At the current stage, WakePaw does not operate its own servers to store your pets, Morning Light, or wake-up voice.

The foregoing data is stored locally on your device. If you have enabled iCloud Backup in iOS system settings, the system may, in accordance with Apple’s rules, automatically back up some data in this App’s sandbox to your own iCloud together with a full-device backup. That backup is provided by Apple, and we cannot read its contents.

Enable or manage iCloud Backup in system Settings; WakePaw will not separately prompt an iCloud authorization inside the App, and on-device identity is not the same as iCloud authorization.

When changing devices, you typically need to choose to restore from an iCloud backup on the new device. Reinstalling the App alone does not, by itself, restore previous on-device data.

2.4 Apple Purchase Records

Purchases, restoring Pro membership, permanent ad removal, or other purchases completed through the App Store are generally determined by your Apple ID purchase records and do not require WakePaw in-app sign-in.

WakePaw on-device identity is not necessarily the same as an Apple App Store purchase account.

2.5 Use Restrictions

You shall not:

  • use this App to engage in illegal activities;
  • exploit program vulnerabilities to obtain virtual assets abnormally;
  • disrupt normal service through automated programs, scripts, or similar means;
  • otherwise maliciously interfere with normal service operation.

2.6 Account Deletion and Clearing On-Device Data

The current version does not provide cloud-account sign-in. This device may still generate a nickname, Wake ID, and related identity information.

You may delete that on-device identity in the App:

Me → Settings → Account Management → Delete Account

Deletion requires an in-app confirmation dialog that clearly explains the consequences. After you confirm, we clear all related app data in this device’s sandbox (including nickname, Wake ID, avatar, alarms, persistence items, pets, Morning Light, badges, wake-up voice, and records). This cannot be undone.

You may also clear on-device app data by uninstalling WakePaw or deleting this App in system Settings.

Please note:

Deleting the account or uninstalling WakePaw is not equivalent to cancelling an Apple App Store auto-renewing subscription.

If you have an auto-renewing service that has not yet expired, you should also cancel the corresponding subscription through the subscription-management features provided by Apple.

If a full-device backup from before deletion or uninstall remains in system iCloud, restoring that backup later may restore the prior on-device state; that is determined by Apple’s backup mechanism.


3. Alarms, Tasks, and System Permissions

3.1 Alarm Permissions

WakePaw’s system-level alarm features depend on system capabilities provided by Apple, such as AlarmKit, and the corresponding authorizations.

You need to grant the required permissions as prompted by the App.

The task page, subsequent reminders, cloud sync, and other enhanced features may also depend on:

  • notification permissions;
  • network;
  • camera permissions;
  • microphone permissions;
  • motion-recognition permissions;
  • other system permissions.

3.2 Situations in Which Reminders May Not Work Normally

We will make reasonable efforts to improve WakePaw’s stability, but no software can guarantee 100% normal operation on all devices and in all circumstances.

The following situations may cause abnormalities in alarms, tasks, reminders, or sync:

  • the device is powered off or the battery is depleted;
  • iOS system abnormalities or crashes;
  • failures in Apple system frameworks;
  • necessary permissions being turned off or revoked;
  • the user deleting the App;
  • the user actively turning off, deleting, or modifying alarms;
  • the user changing the device date, time, or time zone;
  • insufficient device storage;
  • abnormalities in the system version or device environment;
  • network-connection abnormalities causing features that require a network to be unavailable;
  • abnormalities in Apple or other third-party services;
  • other circumstances beyond WakePaw’s reasonable control.

3.3 Limitations on Alarm Use

WakePaw should not be used as the sole:

  • medical reminder tool;
  • medication-taking reminder;
  • emergency-call tool;
  • sole reminder method for flights, exams, or important meetings;
  • monitoring tool for infants, young children, or patients;
  • fire, security, or other safety system;
  • other system where a failed reminder could result in significant personal injury or property damage.

If a reminder matter has significant consequences, we recommend also setting other independent reminder methods.


4. Mission and Physical-Activity Task Safety

4.1 Description of Missions

WakePaw may require users to complete certain tasks after an alarm rings, to help users return to a wakeful state.

Task types may include:

  • math problems;
  • memory;
  • rapid tapping;
  • spot the difference;
  • words;
  • shaking the device;
  • eyes-open detection;
  • squats;
  • jumping jacks;
  • other motion tasks.

Task types and specific rules are as actually displayed in the App.

4.2 Risks of Physical-Activity Tasks

Some Missions involve physical activity.

Before performing any physical-motion task, you should first confirm that:

  • you are already in a condition in which you can move safely;
  • there are no obstacles around you;
  • the ground is stable and not slippery;
  • the current environment does not present dangers that could arise from body movement.

4.3 Prohibited Use in Hazardous Situations

Do not complete Missions that require operating a phone or physical activity in the following situations:

  • while driving a motor vehicle;
  • while riding a bicycle, e-bike, or other vehicle;
  • while walking on a road;
  • while going up or down stairs;
  • while bathing or in a slippery environment;
  • while at a height;
  • while operating machinery, equipment, or tools;
  • while holding an infant or young child;
  • other situations that require sustained concentration or that may present safety risks.

In the foregoing situations, you should give priority to the safety of yourself and others.

4.4 Physical Discomfort

If, while performing a Mission, you experience:

  • dizziness;
  • pain;
  • difficulty breathing;
  • chest tightness;
  • loss of balance;
  • obvious physical discomfort;

you should stop the task immediately.

Users should choose appropriate tasks and difficulty based on their age, physical condition, athletic ability, and actual environment.


5. In-App Assets and Virtual Items

5.1 Nature of Virtual Assets

WakePaw may include:

  • Morning Light;
  • Snooze Cards;
  • food;
  • badges;
  • pet growth values;
  • consecutive-completion records;
  • in-app points;
  • other digitized entitlements.

Except as otherwise provided by law, these items are virtual items or digital entitlements within WakePaw’s services:

  • they are not legal tender;
  • they have no cash value;
  • they may not be exchanged for cash;
  • you may not require WakePaw to repurchase them in real-world currency.

5.2 Obtaining and Consuming

The following aspects of virtual assets:

  • methods of obtaining;
  • methods of consuming;
  • quantities;
  • scope of use;
  • validity periods;
  • settlement upon task failure;
  • reward rules;

are as actually published in the App.

5.3 Rule Adjustments

We may reasonably adjust virtual-asset rules based on:

  • product balance;
  • feature adjustments;
  • technical reasons;
  • operational needs;
  • anti-cheat needs.

For digital goods that have already been actually purchased, paid entitlements that have already taken effect, and core entitlements that users have already lawfully obtained, we will not retroactively deprive them without reasonable grounds solely because of ordinary operational rule adjustments.

5.4 Abnormal Assets

If there exists:

  • exploitation of vulnerabilities;
  • modification of the client;
  • automated scripts;
  • farming rewards through abnormal means;
  • data tampering;
  • other cheating conduct;

we have the right, as the circumstances warrant, to take reasonable measures such as:

  • correcting abnormal data;
  • reclaiming abnormal assets;
  • resetting abnormal records;
  • suspending related features;
  • restricting some features;
  • terminating service.

5.5 Persistence-Type Results

Some of WakePaw’s design may treat “persisting and completing” itself as an important part of the product experience.

Therefore, some results in principle cannot be purchased directly through payment, including without limitation:

  • directly purchasing a successful wake-up result;
  • directly purchasing a Mission completion status;
  • directly modifying genuine task-completion records;
  • directly restoring some records that represent actual persistence results.

Specifics are as provided by in-app rules.


6. Pro Membership, Payments, and Auto-Renewal

6.1 Purchase Channel

WakePaw’s Pro membership, ad removal, permanent unlocks, or other digital goods are completed through the in-app purchase system provided by the Apple App Store.

Actual:

  • prices;
  • currency;
  • taxes;
  • plans;
  • promotions;
  • subscription periods;

are as shown on the purchase page and as displayed by Apple.

6.2 Auto-Renewal

If you purchase an auto-renewing membership, the related subscription will renew in accordance with Apple’s rules at the end of the current subscription period, unless you cancel in advance.

Before purchase, WakePaw will display important subscription information on the purchase page.

Specific auto-renewal rules are set out separately in:

WakePaw Auto-Renewal Membership Agreement

6.3 Managing Subscriptions

Auto-renewing services are managed by Apple.

You may, through the Apple account subscription-management page in the iOS system:

  • view subscriptions;
  • change subscriptions;
  • cancel subscriptions.

Deleting or uninstalling the WakePaw App will not automatically cancel your App Store auto-renewing subscription.

6.4 Restore Purchases

To the extent permitted by Apple’s rules, you may restore, through WakePaw’s “Restore Purchases” and similar features, the following associated with the current Apple ID:

  • active subscriptions;
  • permanent buyout items;
  • other purchases that support restoration.

6.5 Refunds

WakePaw’s in-app purchases are completed through the Apple App Store.

Refund eligibility, refund process, and refund results are primarily determined by:

  • Apple’s refund rules;
  • the laws of the user’s country or region;
  • the specific purchase circumstances.

Except as otherwise mandatorily provided by applicable law, we cannot guarantee that all digital goods that have already been purchased or consumed can be refunded.

6.6 Service Adjustments

If some Pro features are adjusted due to product upgrades, technical adjustments, or service changes, we will make reasonable efforts to ensure that core membership entitlements for which users have already paid will not be substantially reduced without reasonable grounds.


7. User Content

7.1 User-Generated Content

You may be able to create or upload in WakePaw:

  • wake-up voice;
  • nicknames;
  • avatars;
  • custom text;
  • other user content.

Lawful rights in related content in principle remain with you or the original rights holder.

7.2 Necessary License to Use

To provide WakePaw services to you, you agree to grant us a license to use such content only to the extent necessary to provide the related features, for example:

  • local storage;
  • local playback;
  • backup with system iCloud Backup (if you have enabled it in system settings);
  • content display.

Unless we obtain your separate authorization or the law otherwise provides, we will not, by virtue of this Agreement, obtain rights to use content unrelated to providing services to you.

7.3 User Obligations

You shall not upload, record, or disseminate through WakePaw:

  • illegal content;
  • content that infringes others’ copyrights;
  • content that infringes privacy or portrait rights;
  • malicious harassment content;
  • hate, threats, or other illegal or non-compliant content.

7.4 On-Device Recognition

If WakePaw uses motion, pose, facial features, or similar recognition capabilities, the manner of data processing, whether data is uploaded to servers, and similar matters are as described in the WakePaw Privacy Policy.


8. Use by Minors

8.1 Guardian Guidance

If you are a minor under the age of eighteen, please use WakePaw under the guidance of a parent or other guardian.

When paid purchases are involved, you should obtain the guardian’s consent and proceed in accordance with laws and regulations and Apple’s related rules.

8.2 Physical-Activity Tasks

When minors use physical-activity tasks such as squats and pose recognition, particular attention should be paid to task difficulty and the use environment.

We recommend that guardians help minors:

  • choose appropriate tasks;
  • set reasonable task intensity;
  • avoid use in hazardous situations.

8.3 Children’s Personal Information

If WakePaw involves processing children’s personal information as defined by law, we will take corresponding protective measures in accordance with applicable law and the WakePaw Privacy Policy.


9. Intellectual Property

9.1 WakePaw Content

Except for user content or third-party content that is otherwise clearly identified, the following in WakePaw:

  • software code;
  • product names;
  • logos;
  • UI design;
  • page layouts;
  • graphics;
  • illustrations;
  • pet characters;
  • animations;
  • copy;
  • ringtones;
  • sound effects;
  • data structures;
  • other original content;

the related intellectual property belongs to individual developer Lijuan Wu (吴丽娟) or the lawful rights holder.

9.2 Use Restrictions

Without permission from the corresponding rights holder, you shall not:

  • illegally copy;
  • scrape in bulk;
  • modify;
  • sell;
  • lease;
  • sublicense;
  • disseminate;
  • reverse engineer;
  • crack;
  • circumvent paid mechanisms;
  • use WakePaw in other ways that infringe intellectual property.

Except for conduct expressly permitted by law.

9.3 Third-Party Content

Some of the following in WakePaw:

  • fonts;
  • sound effects;
  • open-source components;
  • software frameworks;
  • other resources;

may come from third parties and are used in accordance with the corresponding license agreements or permission rules.

Their intellectual property remains with the corresponding rights holders.


10. Prohibited Conduct

When using WakePaw, you shall not engage in the following conduct:

  • violating laws and regulations;
  • invading servers or the client;
  • cracking WakePaw;
  • modifying app data;
  • circumventing subscription or payment mechanisms;
  • exploiting vulnerabilities to obtain improper benefits;
  • using automated scripts to maliciously farm rewards;
  • attacking servers;
  • affecting other users’ normal use;
  • impersonating others;
  • using WakePaw to engage in fraud;
  • infringing third parties’ lawful rights and interests;
  • other conduct that clearly contradicts the normal purpose of using the product.

If the foregoing conduct occurs, we may take reasonable measures based on the severity of the conduct.


11. Third-Party Services

WakePaw may depend on services provided by third parties, including without limitation:

  • Apple;
  • the App Store;
  • iCloud Backup (provided by the system);
  • Apple system frameworks;
  • cloud service providers;
  • crash-analysis or performance services;
  • other technology service providers.

Third-party services may be affected by their own:

  • terms of service;
  • privacy rules;
  • technical conditions;
  • system maintenance.

If some features are briefly unavailable due to a third-party failure, we will make reasonable efforts to assist in addressing the issue, but we cannot control the third-party services themselves.


12. Service Adjustments, Suspension, and Termination

12.1 Product Adjustments

In order to:

  • improve the user experience;
  • fix issues;
  • ensure system security;
  • adapt to system upgrades;
  • comply with laws and regulations;
  • adjust the business model;

we may add, modify, or discontinue WakePaw features.

12.2 Suspension of Service

In the following situations, some or all services may temporarily be unavailable:

  • system maintenance;
  • Apple service abnormalities;
  • server maintenance;
  • network attacks;
  • security risks;
  • force majeure;
  • requirements of laws and regulations;
  • other reasonable reasons.

12.3 User Termination of Use

You may stop using WakePaw and uninstall the App at any time to clear on-device app data.

12.4 Termination for Violations

If a user seriously or persistently violates this Agreement, we may, based on the actual circumstances:

  • warn;
  • restrict some features;
  • suspend the service;
  • terminate the service;
  • delete illegal or non-compliant content;

except as otherwise provided by law.


13. Disclaimer and Limitation of Liability

13.1 As-Is Service

WakePaw provides services to users according to the product’s current actual state.

We will take reasonable measures to safeguard:

  • product security;
  • service stability;
  • data security;
  • normal functioning of features.

However, because software, devices, and operating systems are themselves complex, we cannot promise that:

  • service will never be interrupted;
  • performance will be entirely consistent across all devices;
  • all features will always be free of errors;
  • WakePaw can meet all users’ special needs.

13.2 Causes Attributable to the User

For problems caused by the user’s own conduct, for example:

  • permissions being turned off;
  • the device running out of battery;
  • deleting the App;
  • deleting alarms;
  • incorrectly setting the time;
  • not following prompts;
  • completing tasks in a hazardous environment;

liability shall be determined in light of the actual circumstances.

13.3 Third Parties and Factors Beyond Control

For service abnormalities caused by factors beyond our reasonable control, such as:

  • Apple system abnormalities;
  • App Store failures;
  • interruption of third-party services;
  • network failures;
  • device hardware problems;
  • force majeure;

we will assume corresponding liability to the extent permitted by applicable law.

13.4 Scope of Liability

To the extent permitted by applicable law, we will assume corresponding liability only for direct losses that we are legally required to bear.

Any limitation of liability in this Agreement does not apply to liability that the law expressly provides may not be limited or excluded, including without limitation:

  • damage caused by our willful misconduct;
  • damage caused by our gross negligence that may not be disclaimed under law;
  • liability for personal injury that the law provides may not be excluded;
  • other liability that may not be limited through standard-form clauses under law.

14. Privacy and Personal Information Protection

We value your privacy and the security of your personal information.

WakePaw’s:

  • collection;
  • use;
  • storage;
  • sharing;
  • deletion;
  • use of permissions;
  • security protection;

of personal information will be carried out in accordance with the WakePaw Privacy Policy.

Before using WakePaw, please also read the WakePaw Privacy Policy.

If a feature needs to access:

  • the microphone;
  • the camera;
  • notifications;
  • motion data;
  • photos;
  • other system permissions;

we will prompt you through system authorization or in-app explanations.


15. Changes to this Agreement

15.1 Ordinary Adjustments

As WakePaw’s features, business, or legal environment change, we may modify this Agreement.

The updated Agreement will be published through:

  • the WakePaw App;
  • the agreement page;
  • other reasonable channels;

and the effective date will be updated.

15.2 Material Adjustments

If a modification involves:

  • charging methods;
  • users’ material rights and interests;
  • main service content;
  • allocation of liability;
  • methods of processing personal information;
  • other matters that have a material impact on users;

we will provide notice through a pop-up, a prominent page prompt, or other reasonable means.

Where the law requires us to obtain the user’s consent again, we will obtain your consent again.


16. Governing Law and Dispute Resolution

The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall in principle be governed by the laws of the People’s Republic of China, excluding its conflict-of-laws rules.

If the mandatory legal provisions of your country or region confer on consumers rights that cannot be excluded, such mandatory provisions still apply.

If a dispute arises from this Agreement or WakePaw services, the parties should first try to resolve it through friendly consultation.

If consultation cannot resolve the dispute, a lawsuit may be filed in accordance with law with a people’s court having jurisdiction.


17. Miscellaneous

17.1 Severability

If some provisions of this Agreement are held to be invalid or unenforceable, the validity of the other provisions is not affected.

17.2 Headings

The headings in this Agreement are for reading and understanding only and do not affect the actual meaning of the related provisions.

17.3 Failure to Exercise Rights

Our failure to immediately exercise a right under this Agreement does not mean that we permanently waive that right.
